Siamcoin Coin Grading
เอกสารนี้กำหนดเงื่อนไขการให้บริการของ Siamcoin Coin Grading (“บริษัท”) สำหรับลูกค้าที่ส่งเหรียญเข้ารับบริการ การส่งเหรียญถือว่าลูกค้าได้อ่าน เข้าใจ และยอมรับเงื่อนไขทั้งหมดแล้ว
1. การยอมรับเงื่อนไข (Acceptance of Terms)
การส่งเหรียญเข้ารับบริการถือว่าลูกค้า:
- ยอมรับข้อกำหนดและเงื่อนไขทั้งหมดของบริษัท
- รับรองว่าตนเป็นเจ้าของเหรียญ หรือมีสิทธิ์ตามกฎหมายในการส่ง
- ยืนยันว่าข้อมูลที่ให้เป็นความจริง
2. ขอบเขตการให้บริการ (Scope of Services)
บริษัทให้บริการ ได้แก่:
- การตรวจสอบความแท้ (Authentication)
- การประเมินสภาพและให้เกรด (Grading)
- การบรรจุในตลับ (Encapsulation)
- การบันทึกข้อมูลและภาพถ่าย (Imaging & Database)
การให้เกรดเป็นความเห็นเชิงวิชาชีพ ไม่ใช่การรับประกันมูลค่าทางการเงินหรือกฎหมาย
3. เงื่อนไขการส่งเหรียญ (Submission Requirements)
ลูกค้าต้อง:
- กรอกข้อมูลการส่งให้ครบถ้วน
- ระบุมูลค่าประเมิน (Declared Value)
- ส่งเหรียญที่ถูกกฎหมาย
บริษัทสงวนสิทธิ์ปฏิเสธรับเหรียญตามดุลยพินิจ
4. มูลค่าประเมินและขอบเขตความรับผิด (Declared Value)
- ลูกค้าเป็นผู้กำหนดมูลค่าประเมิน
- ความรับผิดสูงสุดของบริษัทไม่เกินมูลค่าที่ระบุ
- บริษัทไม่รับผิดชอบหากลูกค้าแจ้งมูลค่าต่ำกว่าความจริง
5. ค่าบริการและการชำระเงิน (Fees & Payment)
- ค่าบริการเป็นไปตามตารางค่าบริการปัจจุบัน
- บริษัทสงวนสิทธิ์ปรับค่าบริการโดยไม่ต้องแจ้งล่วงหน้า
- ค่าบริการไม่สามารถคืนได้เมื่อเริ่มดำเนินการแล้ว
- ค่าบริการพิเศษอาจมีเพิ่มเติมตามลักษณะเหรียญ
6. ข้อจำกัดเกี่ยวกับการให้เกรด (Grading Disclaimer)
- การให้เกรดเป็นความเห็นเชิงวิชาชีพ
- สถาบันอื่นอาจให้เกรดแตกต่าง
- เกรดไม่รับประกันมูลค่าตลาดหรือผลตอบแทน
7. การรับรองความแท้และข้อจำกัด (Authentication Limitation)
บริษัทใช้มาตรฐานวิชาชีพในการตรวจสอบ แต่:
- เทคโนโลยีปลอมแปลงอาจพัฒนาในอนาคต
- การประเมินอิงความรู้ ณ เวลาตรวจสอบ
- บริษัทสงวนสิทธิ์ทบทวนเมื่อมีข้อมูลใหม่
8. ระยะเวลาดำเนินการ (Turnaround Time)
- ระยะเวลาที่แจ้งเป็นการประมาณ
- อาจล่าช้าได้จากปริมาณงานหรือเหตุสุดวิสัย
- บริษัทไม่รับผิดชอบต่อความเสียหายจากความล่าช้า
9. ความเสี่ยงในการขนส่ง (Shipping Risk)
บริษัทไม่รับผิดชอบต่อความเสียหายหรือสูญหายที่เกิดขึ้นระหว่างการขนส่งโดยบุคคลที่สาม
ลูกค้าควร:
- แพ็คเหรียญอย่างเหมาะสม
- ทำประกันพัสดุ
- ใช้บริการขนส่งที่มีระบบติดตาม
10. ข้อจำกัดความรับผิด (Limitation of Liability)
ความรับผิดสูงสุดของบริษัทไม่เกิน:
- มูลค่าประเมินที่ลูกค้าระบุ
หรือ - ค่าบริการที่ชำระแล้ว (แล้วแต่กรณีที่ต่ำกว่า)
บริษัทไม่รับผิดชอบต่อ:
- ความเสียหายทางอ้อม
- การสูญเสียกำไรหรือโอกาส
- ความผันผวนของตลาด
11. ลิขสิทธิ์และสิทธิภาพถ่าย (Image Rights)
ภาพถ่ายเหรียญทั้งหมดเป็นลิขสิทธิ์ของบริษัท
เจ้าของเหรียญและผู้ครอบครองถัดไปสามารถใช้เพื่อการซื้อขายหรือแสดงข้อมูลโดยสุจริต
ห้ามใช้เพื่อการปลอมแปลงหรือบิดเบือนข้อมูล
12. ทรัพย์สินที่ไม่มารับคืน (Unclaimed Property)
หากลูกค้าไม่ติดต่อรับเหรียญภายในระยะเวลาที่เหมาะสม บริษัทมีสิทธิ์เรียกเก็บค่าจัดเก็บหรือดำเนินการตามกฎหมาย
13. เหตุสุดวิสัย (Force Majeure)
บริษัทไม่รับผิดชอบต่อความล่าช้าหรือความเสียหายที่เกิดจากเหตุการณ์นอกเหนือการควบคุม เช่น:
- ภัยธรรมชาติ
- เหตุฉุกเฉิน
- เหตุการณ์ทางกฎหมายหรือรัฐ
14. กฎหมายที่ใช้บังคับ (Governing Law)
ข้อกำหนดนี้อยู่ภายใต้กฎหมายแห่งราชอาณาจักรไทย
ข้อพิพาทให้อยู่ในเขตอำนาจศาลไทย
15. การแก้ไขเงื่อนไข (Amendments)
บริษัทสงวนสิทธิ์แก้ไขเงื่อนไขนี้ได้โดยไม่ต้องแจ้งล่วงหน้า
เวอร์ชันล่าสุดบนเว็บไซต์ถือเป็นฉบับที่มีผลบังคับใช้
Terms and Conditions of Service
Siamcoin Coin Grading
These Terms and Conditions (“Terms”) govern all services provided by Siamcoin Coin Grading (“Siamcoin” or “the Company”). By submitting coins for service, the submitter (“Client”) acknowledges that they have read, understood, and agreed to these Terms.
1. Acceptance of Terms
By submitting any item to Siamcoin, the Client:
- Accepts all Terms and Conditions set forth herein
- Warrants that they are the legal owner of the submitted item or authorized to act on behalf of the owner
- Confirms that all information provided is true and accurate
2. Scope of Services
Siamcoin provides professional numismatic services, including but not limited to:
- Authentication examination
- Grading evaluation
- Encapsulation (protective holder)
- Imaging and digital documentation
- Database record and certification
Grading represents a professional opinion and does not constitute a guarantee of market value, financial outcome, or legal determination.
3. Submission Requirements
The Client must:
- Complete all required submission information accurately
- Declare an estimated value (“Declared Value”) for each item
- Ensure all submitted items comply with applicable laws
Siamcoin reserves the right to refuse any submission at its sole discretion.
4. Declared Value and Insurance
- The Client is solely responsible for determining the Declared Value
- Siamcoin’s maximum liability shall not exceed the Declared Value provided
- Siamcoin shall not be liable for under-declared values
5. Fees and Payment
- Service fees are based on Siamcoin’s current fee schedule
- Siamcoin reserves the right to adjust fees without prior notice
- Fees are non-refundable once processing has commenced
- Additional fees may apply for special handling, conservation, or non-standard items
6. Grading Disclaimer
Grading is an expert opinion based on Siamcoin grading standards.
Siamcoin does not guarantee:
- That another grading service will assign the same grade
- That grading interpretation will remain unchanged over time
- That the assigned grade will correspond to any market value
7. Authentication Limitation
Authentication is performed according to professional standards and knowledge available at the time of examination.
Siamcoin:
- Does not guarantee protection against future counterfeit discoveries
- Reserves the right to revise conclusions if new information becomes available
8. Turnaround Time
All turnaround times are estimates only.
Delays may occur due to workload, complexity, or circumstances beyond Siamcoin’s control.
Siamcoin shall not be liable for any losses resulting from delays.
9. Shipping Risk
Siamcoin is not responsible for loss or damage occurring during third-party transportation.
Clients are strongly advised to:
- Package items securely
- Insure shipments appropriately
- Use trackable and secure delivery services
10. Limitation of Liability
Siamcoin’s total liability shall not exceed:
- The Declared Value of the item, or
- The service fee paid, whichever is lower.
Siamcoin shall not be liable for:
- Indirect, incidental, or consequential damages
- Loss of profits or business opportunity
- Market value fluctuation
11. Image Rights and Copyright
All images, digital records, and photographic materials produced by Siamcoin remain the intellectual property of Siamcoin.
Siamcoin grants a non-exclusive, good-faith usage right to:
- The coin owner
- Subsequent owners
- Buyers and sellers
Images may be used for legitimate resale, auction, documentation, and educational purposes, provided they are not altered or misrepresented.
Unauthorized commercial misuse, fraud, or counterfeit use is strictly prohibited.
12. Unclaimed Property
If the Client fails to claim returned items within a reasonable period, Siamcoin reserves the right to:
- Charge storage fees
- Take action as permitted by applicable law
13. Force Majeure
Siamcoin shall not be liable for delays or losses caused by events beyond its reasonable control, including but not limited to:
- Natural disasters
- Government action
- War, civil disturbance, or emergency events
- System or infrastructure failures
14. Governing Law
These Terms shall be governed by the laws of the Kingdom of Thailand.
Any disputes shall be subject to Thai jurisdiction.
15. Amendments
Siamcoin reserves the right to modify these Terms at any time without prior notice.
The latest version published on the official website shall prevail.
